Terms of Use

  1. Purpose
    These Terms of Use (hereinafter the “Terms”) aim to define the terms and conditions of access to and use of the website embalforme.fr (hereinafter the “Site”), operated by Emballe-Forme, a simplified joint-stock company with a capital of €70,000, registered with the Nanterre Trade and Companies Register under number 390 776 805, whose registered office is located at 20, rue d’Armenonville, 92200 Neuilly-sur-Seine (hereinafter the “Company”). The Site is also accessible via the domains embalforme.com, aberconcept.fr, and aberconcept.com.

The Site presents the packaging solutions for cosmetic products offered by the Company and allows professional internet users (hereinafter the “Visitor(s)” or “you”) to request quotes for standard or customized products, as well as to access general information about these products.

  1. Scope
    These Terms apply to any browsing or use of the Site, whether for consulting the products offered by the Company, requesting the creation of packaging, submitting a contact or quote request to the Company, subscribing to the newsletter, or requesting documents or information.

The Terms do not govern the Company’s sales, which are subject to separate General Terms of Sale (GTS), provided when a quote is issued.

Any use of the Site constitutes full and unconditional acceptance of these Terms. By accessing and using the Site, you acknowledge that you have read and accepted all of these Terms.

If you do not accept all or part of these Terms, you are not authorized to use the Site.

  1. Access to the Site
    The Site is freely accessible to any Visitor with internet access.

No customer account is required to consult the Site, add products to a quote request, submit a contact request, or use the customization tool.
The costs of access and use of the telecommunications network remain the responsibility of the Visitor.
The Company strives to ensure continuous access to the Site but cannot be held responsible for interruptions, errors, or temporary unavailability, regardless of the cause (maintenance, updates, technical issues, force majeure, etc.).

4. Site Features
The Site allows the Visitor to:

  • consult the catalog of packaging solutions offered by the Company;
  • select one or more products to request a customized quote;
  • use a packaging configuration tool;
  • submit an information request via the contact form.

A quote request does not constitute a firm order.
Any subsequent order will be subject to a commercial proposal or separate quote, expressly accepted by the Company. The Company also reserves the right not to respond to certain requests.

5. Rights and Obligations of the Site Visitor
The Visitor is authorized to:

  • consult the pages of our Site using a web browser;
  • temporarily download pages solely to cache them as part of normal browsing;
  • share the product sheet with a person of their choice;
  • use the customization features and services offered on the Site via your browser.

In all other cases, the Visitor is not authorized to download, copy, save, or reproduce any content protected by intellectual property rights on our Site.
Use of the Site is strictly limited to internal professional purposes, excluding any commercial exploitation or distribution to third parties. Any other use is prohibited.
You are specifically not authorized to modify, alter, edit, or adapt the Site content, regardless of format or purpose.

Consequently, the Visitor undertakes to:

  • use the Site in accordance with its intended purpose and in compliance with applicable laws and regulations;
  • provide accurate, sincere, and up-to-date information when completing a contact form or quote request;
  • not compromise the integrity or operation of the Site, nor attempt to gain unauthorized access to its systems;
  • not use the Site for illegal or fraudulent purposes.

The Company reserves the right to refuse or delete any manifestly abnormal or fraudulent quote request.

  1. Products, Prices, and Applicable Conditions
    The products and packaging solutions presented on the Site are for informational purposes only. We reserve the right to modify them at any time without prior notice. We do not guarantee continuous availability of a specific product or product category.

Technical information and specifications on product sheets are provided as a guide and may contain approximations or errors. They will be specified and confirmed when the quote is issued.

No prices are displayed on the Site. Any request submitted by a Visitor will result in a personalized quote issued by the Company. Prices, deadlines, and applicable conditions are those expressly stated in the quote and governed by the Company’s GTS. These elements are valid for the period specified in the quote. After this period, the Company reserves the right to modify the terms of its offer.

  1. Intellectual Property

7.1 The Site
The Site may contain confidential information as well as data protected by intellectual property rights.

Unless otherwise stated, intellectual property rights on documents and any data of any kind contained on the Site and on each element making up the Site (images, illustrations, sounds, texts, graphic elements, branding, etc.), including databases and newsletters, are the exclusive property of the Company (hereinafter the “Content”), which grants no license or other rights except to view the Site.

Reproduction of all or part of the Content is limited to the provisions of Article 5 of these Terms; any reproduction or use of copies for other purposes in any form is expressly prohibited.

It is also prohibited to copy, modify, create derivative works, assemble, decompile (except as permitted by law), sell, assign, sublicense, or transfer any rights relating to the Content.
It is also prohibited to modify any part of the Content to obtain unauthorized access to the service or to access the Site by any means other than the interface provided to the Visitor by the Company.

7.2 Trademarks
The Company owns the verbal trademark “Embalforme”.

The Visitor acknowledges the Company’s exclusive rights to the Embalforme trademark and agrees not to use it in any way and more generally not to infringe the Company’s intellectual property rights.
The Company reserves the right to claim damages in the event of counterfeiting or any infringement of its intellectual property rights. Similarly, the Visitor shall not infringe the intellectual property rights of any company within the Group to which the Company belongs.

All other trademarks or logos appearing on the Site are the property of the Company, a company in its Group, or its service providers, partners, clients, or suppliers.
Any use of these trademarks and/or logos and/or any other Content is subject to the express prior authorization of the Company or the intellectual property rights holder.

  1. Personal Data and Cookies
    In the course of operating the Site, the Company may collect and process certain personal data concerning Visitors and may use cookies.
    Such processing and use of cookies are carried out in accordance with applicable laws, including Regulation (EU) 2016/679 (GDPR) and French Law No. 78-17 of 6 January 1978, as amended.
    Purposes, legal bases, retention periods, and rights of individuals are detailed in the Privacy Policy accessible on the Site.
  2. Liability
    The Company takes all reasonable steps to ensure the accuracy of information on the Site.
    However, it cannot guarantee that:
    – all Site content is free from errors, omissions, or reflects the most recent product updates
    – content or services on the Site are constantly updated;
    – the Site or any of its services is accessible or available continuously, without interruption or error;
    – Site services or features fully meet your specific needs or circumstances.

The Site is provided “as is” and its use is at your sole risk.
The Company’s liability cannot be engaged:

  • in the event of Site interruption or inaccessibility;
  • for indirect damages resulting from use of the Site;
  • for use of the Site contrary to these Terms.

This limitation does not apply in the case of gross or intentional fault by the Company or bodily harm caused to a Visitor.

  1. Hyperlinks
    The Site may contain links to other websites operated by third parties. These links are provided for informational purposes only and do not constitute endorsement or recommendation. We have no control over the content or operation of these third-party websites.
    Consequently, the Company disclaims all liability for the content, operation, or availability of such third-party sites, or for any damage or loss resulting from their use.
  2. Violations of the Terms
    Without prejudice to any other rights we may exercise, in the event of a violation of these Terms, or if we have reasonable grounds to suspect such a violation, we reserve the right to take any measures we deem appropriate, including, without limitation:
    – sending one or more warnings;
    -temporarily suspending your access to all or part of the Site;
    -permanently prohibiting access to all or part of the Site;
    -initiating legal proceedings against you, including for breach of contract.

In case of suspension, prohibition, or blocking of your access to the Site, you agree not to attempt to circumvent such measures, including by creating or using another account.

  1. Non-Waiver
    The Company’s failure to immediately invoke a Visitor’s breach of any obligations under these Terms shall not be interpreted as a waiver of the right to enforce it later, nor as a waiver to assert any other breach.

Similarly, the absence or delay in exercising a right or remedy provided herein shall not be considered a waiver of that right or remedy.
Any express waiver by the Company shall apply only to the specific case concerned and shall not extend to other situations.

13.1. Modifications
The Company reserves the right to modify and update these Terms at any time without prior notice. Modified Terms are effective upon publication. Visitors are advised to review the Terms regularly.
Use of the Site is subject to the Terms in effect at the time of use.

13.2. Entire Agreement
These Terms, our Privacy Policy, and our General Terms of Sale constitute the entire agreement between you and the Company regarding your use of the Site.
They supersede any prior agreement, arrangement, or understanding, written or oral, relating to the same subject.
If any clause of these Terms is nullified due to legislative, regulatory changes, or judicial decision, this shall not affect the validity and compliance of the remaining clauses.
Section titles are for convenience only and do not affect the meaning or interpretation of the clauses and provisions of these Terms.

13.3. Governing Law
These Terms are governed by French law.
Any dispute regarding the existence, interpretation, performance, or termination of the contract between the Company and the Visitor, even in the event of multiple defendants, shall, failing an amicable agreement, fall under the exclusive jurisdiction of the Courts of Nanterre. This jurisdiction applies notwithstanding multiple defendants or third-party proceedings, including urgent or precautionary proceedings.
