The company Emballe-Forme (hereinafter “Embalforme” or “we” or “our”) takes the protection of privacy and Personal Data very seriously.

This privacy policy (hereinafter the “Policy”) aims to inform you about how we process your Personal Data and the commitments made by Embalforme to ensure the protection of such Data.

This Policy applies to the website embalforme.fr (hereinafter the “Site”, also accessible in French or English at “embalforme.com”, “aberconcept.fr” and “aberconcept.com”) as well as to all goods and services offered by Embalforme (hereinafter the “Services”), and complements the “Terms of Use” and the “General Terms of Sale”, as well as any other document referring to this Policy.

For the purposes of this Policy, the terms “Personal Data” or “Data”, “Processing”, “Data Controller”, and “Processor” have the meaning given to them in Article 4 of the General Data Protection Regulation.

    We ensure that we collect and process Personal Data that is relevant, adequate, not excessive, and strictly necessary to achieve the purposes previously determined.

When using the Site, Embalforme collects and processes certain Personal Data concerning you in your capacity as a Site user, prospect, or customer (all hereinafter referred to as “User(s)” or “you”).

Users’ Personal Data is collected when:

  • You contact us to request a quote: in this case, we collect mandatory information: first name, last name, company, position, country, phone number, and email address; and optional information: postal address (street, postal code, city) and comment.
  • You subscribe to our newsletter: in this case, we collect mandatory information: email address, phone number, and company name; and optional information: first name, last name, and position.
  • You request our catalog or other documents: in this case, we collect mandatory information: first name, last name, email address, and company name; and optional information: phone number, position, sector, and country/region.
  • You confirm your quote request (note that sending and accepting the quote occurs outside the Site): first name, last name, company, position, postal address (street, postal code, city, country), phone number, email address, and, when the quote is accepted, bank details.

When your Personal Data is submitted via a form, mandatory fields (*) that you must complete are indicated at the time of collection. Failure to provide the required information, or any response deemed abnormal by Embalforme, may result in your request not being processed.

  1. Why Do We Process Your Personal Data and What Is the Legal Basis?
    Embalforme is committed to collecting and processing your Personal Data fairly and lawfully. Processing carried out by Embalforme serves explicit, legitimate, and determined purposes.

Your Personal Data may be processed for the following purposes:

  • For managing contact or quote requests. The processing aims to manage these requests submitted by you, to follow up, and to respond to them.
    The legal basis for this processing is your consent to allow Embalforme to process these requests and respond.
  • Users’ and/or prospects’ Personal Data is processed to analyze navigation on the Site (please see our Legal Notice).
    The legal basis for this processing is your consent to allow Embalforme to continuously improve the Site.
  • For executing an order following a quote. The processing aims to prepare and deliver your order according to the terms specified in your quote.
    The legal basis for this processing is the performance of a contract to allow Embalforme to process and deliver your order.
  • For managing and sending the newsletter, to keep you informed of company news, offers, and updates.
    The legal basis for this processing is your consent to allow Embalforme to send the newsletter.
  • For providing documents and information (catalogs, charters, etc.). The processing aims to manage and respond to these requests submitted by you.
    The legal basis for this processing is your consent to allow Embalforme to process these requests and respond. The transmission of these documents and information is not automatic and is subject to approval by our teams.
  1. How Long Do We Keep Your Personal Data?
    Embalforme retains your Personal Data only as long as necessary to achieve the purposes for which it was collected and processed.

Retention periods are as follows:

  • Data collected via Site forms: retained for the duration necessary to process the forms.
  • Data collected for order execution following a quote: retained for the duration necessary to execute the order, then for a maximum of 5 years after the end of the relationship.
  • Data collected for newsletter management and sending: retained until you unsubscribe, or, if not, for a maximum of 3 years from the last contact initiated by you (unless consent is withdrawn earlier).
  • Data collected for sending documents or information (catalogs, charters, etc.): retained for the time necessary to process and send the requested materials, then for a maximum of 3 years from the last contact initiated by you (unless consent is withdrawn earlier).
  1. Who Has Access to Your Personal Data?
    Personal Data collected and processed by Embalforme is accessible only to internal teams responsible for handling your requests related to the Services.

For order execution following a quote, some of your Personal Data may also be shared with partners involved in fulfilling or delivering the order.

  1. Is Your Personal Data Transferred Outside the European Union?
    Personal Data collected by Embalforme is hosted in France and may be occasionally transferred outside the European Union for the purpose of fulfilling certain orders.
  2. What Are Your Rights?
    Under Applicable Regulations, you have the following rights regarding your Personal Data:
  • Right of access: you have the right to obtain (i) confirmation as to whether Personal Data concerning you is being processed and, if so, (ii) access to that data and a copy thereof.
  • Right to rectification: you have the right to obtain correction of inaccurate Personal Data concerning you and to have incomplete data completed, including by providing a supplementary statement.
  • Right to erasure: you have the right to request deletion of your Personal Data. This right is not absolute, and Embalforme may have legal or legitimate reasons to retain such data.
  • Right to restriction of processing: you have the right to request the restriction of processing of your Personal Data.
  • Right to withdraw consent: you have the right to withdraw your consent at any time.
  • Right to data portability: you can request to receive the Personal Data you provided in a structured, commonly used, and machine-readable format, to keep it for personal use or transfer it to another organization.
  • Right to give instructions regarding data after death: you can provide Embalforme with directives regarding the use of your Personal Data after your death.
